The accused, either an adult or a minor, can apply for and/or be granted a suspended sentence in the following five instances:

a. When he is eligible for probation;
b. When he is eligible for parole;
c. When he is insane;
d. In cases of conditional pardon;
e. When a pregnant woman is sentenced to death, while she is pregnant and within one year after delivery.
